Restoration of Status: The Critical Dates That Matter

Restoration of status is not just about filling out forms. It is a race against time, and the clock starts ticking the moment your authorization ends. Many applicants lose their case not because they are ineligible, but because they misunderstand which date triggers the deadline.

If you are considering restoration, you must rebuild your timeline before you write a single word of explanation. The officer will look at the gap between your last authorized activity and your application submission. If that gap exceeds ninety days, the door closes.

Check Your Expiry Date

The first date to verify is the expiry date on your current permit. This is not the date you plan to leave. It is the date printed on the document. If you are inside Canada, you likely have implied status if you applied before that date. But if you are applying for restoration, you are admitting that status has lapsed.

Do not assume that staying in Canada past the expiry date gives you more time. It does. It only gives you ninety days from the date you lost status to apply.

Identify the Date Status Was Lost

This is where confusion often happens. Status is lost on the expiry date, or on the date of a refusal letter if you applied for an extension and were refused.

If you received a refusal, check the date on the letter. That is often the date your status ended, even if your permit had a later expiry. You must calculate the ninety days from that specific refusal date. If you wait until the permit expiry date to start preparing, you may already be out of time.

Determine When You Stopped Working or Studying

Are you still in Canada? Restoration is generally only available if you are inside Canada. If you have left, you must apply for a new permit from abroad. This changes the entire process.

Also, consider your current activity. If you are studying without authorization, you must stop immediately. If you are working, you must stop. Continuing to violate conditions while applying for restoration shows a lack of respect for immigration rules.

When to Seek Professional Help
