Can My Spouse Work in Canada If I’m a Worker with a TEER 3 Job?

I’m a foreign worker in Canada on a work permit, and my spouse wants to apply for an open work permit. I’m in a TEER 3 job under NOC 63200. I’ve heard things are stricter now—especially around occupation type and job status. I’m currently employed full-time, have valid pay stubs, and my employer confirmed my job is ongoing. But I saw posts saying TEER 3 roles might not qualify anymore.

I’m not sure what’s actually required now. I’ve heard the immigration office checks if the job is still active, if the employer is compliant, and whether the NOC/TEER matches the actual duties. I know I can’t apply based on an old permit or outdated job info. So I want to make sure I’m not making a mistake before submitting.

Here are my main questions:

1. Does my TEER 3 job still qualify for a spouse open work permit under the SOWP program?

2. Is it enough to have a recent employment letter and pay stubs, or do I need more proof of active employment?

3. If my job changes to a different TEER level later, does that affect my spouse’s permit status?

4. Should I wait until my current work permit renewal is approved before applying for my spouse’s open work permit?

I’ve read that the focus is now on current job reality—not just the permit type or old documents. So I want to be extra careful. My spouse has a degree and is eager to work, but I don’t want to risk a rejection due to incorrect assumptions.

If you’re in a similar situation—especially with TEER 3 or 4 jobs—please share your experience. What province are you in? What’s your current work permit status? How long did it take from application to approval?

Just keep your details general—no need to post passport numbers, UCI, or bank info. We’re all learning together.

Yes, your spouse may be eligible to work in Canada if you’re a worker with a TEER 3 job, but it depends on the type of work permit you hold. If you have a valid work permit issued under a program like the International Mobility Program or the Temporary Foreign Worker Program, your spouse can apply for a work permit under the Spousal Work Permit program. However, the permit is only valid if your job is in a TEER 3 or higher category *and* the job offer is supported by a positive Labour Market Impact Assessment (LMIA), unless exempt.

Common pitfalls include assuming all TEER 3 jobs qualify—some may not, especially if the job is non-essential or falls under a restricted category. Also, the work permit for your spouse is tied to your status: if your work permit ends or is canceled, their permit also ends.

To give you a better answer, could you confirm:
1. Which province are you working in?
2. Are you on a LMIA-exempt or LMIA-supported work permit?
3. How long do you expect your work permit to be valid?

Please don’t share personal IDs or full names.
