No credit history? Is paying months' rent upfront legal?
As a new immigrant, I’ve been asked by several landlords to pay 2–3 months’ rent upfront because I don’t have a Canadian credit history. I get why they’re cautious, but I’m wondering—how common is this across provinces? Is it actually allowed, or just a common practice that might not be enforceable?
I’ve heard that in Ontario and BC, landlords can’t legally demand more than one month’s rent as a security deposit, and pre-paying rent beyond that is usually up to the tenant. But in other provinces, like Alberta or Quebec, the rules might be different. Does anyone know the exact provincial laws here?
I’ve been trying to offer alternatives: a letter from my employer, bank statements showing stable income, and even a reference from a previous landlord. Some places accept these, others don’t. Has anyone successfully used a guarantor or a rental reference letter to avoid paying extra upfront?
Also, what happens if I pay three months in advance and then leave early? Can I get the unused portion back, or is it treated like a non-refundable deposit? Is there a way to protect myself in the contract?
